Liability Waiver

By boarding any vessel arranged through 305 Yachts, you acknowledge and accept the following terms:

1. Assumption of Risk

Boating and water-related activities involve inherent risks including but not limited to drowning, injury from slips and falls, weather conditions, and equipment malfunction. You voluntarily assume all such risks.

2. Release of Liability

You release 305 Yachts, its owners, and employees from any and all liability for injury, loss, or damage arising from your participation in the charter, except in cases of gross negligence or willful misconduct.

3. Captain Authority

The licensed captain has final authority over all safety matters including route, speed, and termination of the charter due to weather or unsafe conditions. No refunds will be issued for early termination due to safety concerns or passenger misconduct.

4. Passenger Conduct

Illegal substances, underage drinking, and unsafe behavior are strictly prohibited. The captain may terminate the charter immediately without refund for violations. Maximum 12 guests plus the independently hired captain.

5. Damage Deposit

A $200 refundable safety deposit is collected before departure. This covers minor damage or excessive cleaning. The deposit is refunded after the charter if no damage occurs.

6. Acknowledgement

By proceeding with your booking and boarding the vessel, you confirm that you have read, understood, and agree to this waiver. A physical copy will be provided for signature on the day of your charter.
