1. Booking and Reservation
All charter bookings are confirmed upon receipt of the required reservation fee and issuance of a confirmation by 305 Yachts ("we," "us," "our"). The person making the booking ("you," "guest") represents that they are at least 21 years of age and authorized to enter into this agreement on behalf of all members of their party.
Bookings are subject to vessel availability. We reserve the right to substitute a vessel of comparable or higher quality if the booked vessel becomes unavailable due to maintenance, mechanical issues, or other circumstances beyond our control.
2. Payment
A non-refundable reservation fee is required to secure your booking. The remaining balance, if any, is due as specified in your booking confirmation. Payments may be made via credit card, debit card, or other methods we specify. All prices are in US dollars.
Your charter price includes the boat, fuel, and standard amenities. A separate $200 refundable safety deposit is collected before departure. Captain gratuity is not included in the listed charter price.
3. Cancellation Policy
The reservation fee is non-refundable. If you need to cancel your booking, we encourage you to contact us as soon as possible. While the reservation fee cannot be refunded, we will make every effort to accommodate a reschedule to an available date, subject to vessel availability.
No-shows and cancellations made less than 48 hours before the scheduled departure time forfeit any amounts paid. We strongly recommend securing travel insurance that covers trip cancellation.
4. Weather Policy
If the captain cancels for unsafe weather, we reschedule first. If that's not possible, we refund per your booking confirmation. Light rain, cloud cover, or personal weather preferences are not considered unsafe weather. The captain makes the final weather call.
5. Safety Rules
All guests must attend the pre-departure safety briefing conducted by the captain. Life jackets and other safety equipment are provided and must be used as directed. Guests must follow all instructions given by the captain and crew at all times.
Children under 12 must be accompanied by a responsible adult at all times. Guests must remain seated while the vessel is underway unless otherwise permitted by the captain. Swimming is allowed only when the vessel is anchored and the captain has given explicit permission.
6. Liability
Boating, swimming, and water-related activities involve inherent risks, including but not limited to slips, falls, motion sickness, injury, and drowning. By booking a charter, you acknowledge and assume these risks.
305 Yachts, its owners, employees, and contractors shall not be held liable for personal injury, loss of life, loss or damage to personal property, or any other damages arising from or related to the charter, except where caused by our gross negligence. Guests are encouraged to secure their own travel, medical, and personal property insurance.
7. Prohibited Items
The following are strictly prohibited on all vessels: illegal drugs and controlled substances, weapons of any kind, glass containers on vessels where prohibited by the captain, fireworks, pyrotechnic devices, and any item that poses a safety or environmental risk. The captain reserves the right to confiscate and refuse boarding to any person carrying prohibited items.
Smoking (including vaping) is permitted only in designated areas as directed by the captain. Disposal of any waste, plastics, or pollutants into the water is strictly forbidden.
8. Captain's Authority
The captain has absolute authority over the vessel, its crew, and all guests at all times. The captain may terminate any charter early, refuse boarding to any guest, or modify the itinerary without notice if, in the captain's sole judgment, doing so is necessary for the safety of the vessel, crew, or guests.
Guests who fail to follow captain's instructions, behave in a manner that endangers others, or appear to be under the influence of alcohol or drugs to a degree that creates a safety risk may be removed from the vessel at the nearest suitable dock. No refund will be issued in such circumstances.
9. Changes to Terms
We reserve the right to update or modify these terms and conditions at any time without prior notice. Changes take effect immediately upon posting. Your continued use of our services after any changes constitutes acceptance of the updated terms. We encourage you to review this page periodically.
